These Terms and Conditions govern your access to and use of the GRILLSPIN website, store, products, content, features, tools, customer accounts, communications, and related services (collectively, the "Services").

GRILLSPIN operates the Services through Shopify and may use authorized third-party service providers for functions including payment processing, fulfillment, shipping, customer support, analytics, security, and other business operations.

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and Conditions together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree to these Terms and Conditions, you should not use the Services.

Eligibility

You may use the Services only if you are legally capable of entering into a binding agreement under the laws that apply to you.

If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and authorization of a parent or legal guardian where required by law.

Terms Updates

GRILLSPIN may update these Terms and Conditions from time to time to reflect changes in our products, Services, business operations, legal requirements, technology, or policies.

Revised Terms will be posted on the Services with an updated "Last updated" date.

Changes will apply prospectively except where applicable law permits otherwise.

Use of the Services

You may use the Services only for lawful personal or commercial purchasing purposes consistent with these Terms.

You must not use the Services:

for any unlawful, fraudulent, deceptive, abusive, or malicious purpose;
to violate applicable laws, regulations, or third-party rights;
to interfere with the operation or security of the Services;
to distribute malware, malicious code, automated attacks, or harmful content;
to impersonate another person or misrepresent your identity;
to obtain unauthorized access to accounts, systems, data, or restricted areas;
to interfere with another customer's use of the Services; or
to engage in conduct that materially harms GRILLSPIN, our customers, providers, or partners.

Intellectual Property

The Services and all content made available through them are owned by, licensed to, or lawfully used by GRILLSPIN and are protected by applicable intellectual-property laws.

This includes, where applicable:

the GRILLSPIN name and branding;
logos and marks;
product photographs;
videos;
GIFs and animations;
graphics and illustrations;
product demonstrations;
website layouts and visual designs;
advertising creative;
written product descriptions;
marketing copy;
icons and visual assets;
original compositions and edited media; and
other proprietary materials displayed through the Services.

Except as expressly permitted by GRILLSPIN in writing or by applicable law, no content from the Services may be copied, reproduced, downloaded, saved, republished, uploaded, transmitted, distributed, licensed, sold, modified, adapted, commercially exploited, or used to create derivative works.

Protection of GRILLSPIN Media

GRILLSPIN invests substantial time and resources in creating and developing its product photographs, demonstrations, videos, GIFs, graphics, advertisements, and other media.

Except where permitted by applicable law, you may not:

download or save GRILLSPIN media for redistribution;
copy or republish GRILLSPIN product media on another website, marketplace, social platform, advertisement, or storefront;
use GRILLSPIN media to market or sell another product or business;
screen-record or screen-capture GRILLSPIN media for republication, redistribution, or commercial use;
remove, obscure, alter, or circumvent copyright notices, branding, watermarks, access controls, or media-protection measures;
scrape, crawl, harvest, archive, or systematically collect GRILLSPIN media;
train, fine-tune, build, or commercially develop a model, dataset, product, or service using GRILLSPIN proprietary media without authorization;
create substantially similar advertisements using GRILLSPIN media as source material without permission; or
claim ownership of GRILLSPIN content.

Viewing publicly displayed content through the Services does not transfer ownership or grant a license for commercial reuse.

Limited Permission to Use the Website

Subject to these Terms, GRILLSPIN grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose.

This permission does not include the right to reproduce, redistribute, commercially exploit, or create derivative works from GRILLSPIN content.

Automated Access, Scraping & Bots

Unless GRILLSPIN expressly authorizes it in writing, you may not use automated systems to access, copy, index, scrape, crawl, extract, monitor, or harvest content from the Services.

Prohibited automated activity may include:

scrapers;
crawlers;
bots;
data-mining tools;
automated image or video downloaders;
unauthorized API access;
automated purchasing abuse;
credential-testing systems; or
systems designed to bypass technical restrictions.

Ordinary search-engine indexing authorized by GRILLSPIN is not prohibited by this section.

Product Information

GRILLSPIN makes reasonable efforts to present product information accurately.

Product descriptions, photographs, demonstrations, specifications, measurements, features, colors, packaging, accessories, and other information may occasionally vary because of manufacturing changes, screen settings, production updates, photography, or other reasonable factors.

Minor differences that do not materially affect the product's identity or represented functionality do not necessarily constitute a defect.

Nothing in this section permits GRILLSPIN to materially misrepresent a product or limits rights relating to goods that do not conform to legally required standards.

Product Performance & Marketing Claims

GRILLSPIN intends product-performance, comparison, pricing, availability, and promotional claims to reflect a reasonable and accurate representation of the applicable product or offer.

Individual results may vary depending on grill condition, buildup, surface material, cleaning technique, product condition, and other factors.

Demonstrations are intended to illustrate product use and are not a guarantee that every grill, stain, residue, buildup, or cleaning circumstance will produce identical results.

Product Safety & Proper Use

Customers are responsible for using GRILLSPIN products in accordance with applicable product instructions, warnings, safety information, and reasonable care.

Do not use a product in a manner that is unsafe, unlawful, inconsistent with its intended purpose, or contrary to provided instructions.

If a product appears damaged, defective, unusually hot, electrically unsafe, or otherwise presents a possible safety concern, discontinue use and contact GRILLSPIN Support.

Orders

Placing an order constitutes an offer to purchase the products identified in the order.

Receipt of an order confirmation does not necessarily constitute final acceptance of the order or confirmation that the order has shipped.

GRILLSPIN may review an order for payment authorization, product availability, fraud prevention, shipping eligibility, pricing accuracy, regulatory compliance, or other legitimate business reasons.

Orders We May Refuse or Cancel

To the extent permitted by applicable law, GRILLSPIN may refuse, limit, or cancel an order before shipment for reasons including:

product unavailability;
payment failure;
suspected fraud;
unauthorized payment;
identity misuse;
pricing or listing errors;
shipping restrictions;
legal or regulatory restrictions;
suspected resale or purchasing abuse;
technical errors;
security concerns; or
inability to fulfill the order.

If GRILLSPIN cancels an order after payment has been collected and merchandise is not shipped, the applicable amount will be refunded as required by law.

Purchase Limits & Resale

GRILLSPIN may establish reasonable purchase limits or review unusually large, repetitive, automated, or suspicious orders.

We reserve the right, where permitted by law, to restrict orders that reasonably appear intended for unauthorized resale, fraudulent activity, market manipulation, promotional abuse, or other misuse.

Pricing

Prices are displayed in the currency shown through the Services and may change for future purchases without notice.

A price change does not affect a completed purchase except where a transaction must be corrected or cancelled because of a genuine pricing error and applicable law permits such action.

Taxes, shipping charges, duties, import charges, and other amounts may apply as described at checkout or in our Shipping Policy.

Pricing & Listing Errors

Despite reasonable efforts, product listings may occasionally contain typographical, technical, pricing, inventory, or descriptive errors.

Where permitted by applicable law, GRILLSPIN may correct a genuine error, update information, or cancel an affected unfulfilled order.

If payment has already been collected for an order that GRILLSPIN lawfully cancels because of such an error, the applicable amount will be refunded.

Promotions & Discounts

Promotions, discounts, free-shipping offers, coupon codes, limited-time offers, and similar programs may be subject to additional conditions disclosed with the offer.

Unless expressly stated otherwise:

promotions cannot be combined;
discounts have no cash value;
offers may be limited by time, geography, product, order value, or customer;
promotions may not apply retroactively to previous purchases; and
fraudulent or abusive promotional use may be rejected where permitted by law.

Payments

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with the order.

Payment processing may be performed by Shopify or other authorized payment providers and may be subject to their own applicable terms.

Fraud Prevention

GRILLSPIN may use reasonable fraud-prevention, payment-verification, identity-verification, transaction-monitoring, or security procedures.

An order may be delayed, held, refused, or cancelled where permitted by law if there is a reasonable concern involving fraud, unauthorized payment, identity misuse, suspicious activity, or security risk.

Customer Accounts

If you create a customer account, you are responsible for maintaining the confidentiality and security of your account credentials.

You must provide accurate information and should promptly update information that changes.

You are responsible for activity occurring through your account to the extent permitted by law.

Contact GRILLSPIN promptly if you believe your account has been compromised.

Order Cancellations

Customers may request cancellation before fulfillment begins.

Once fulfillment, processing, packing, or shipment has begun, GRILLSPIN cannot guarantee that a voluntary cancellation can still be completed.

A cancellation request is not effective until GRILLSPIN confirms that the cancellation was successfully completed.

Any mandatory cancellation, withdrawal, or cooling-off rights available under applicable law remain unaffected.

Shipping & Delivery

Orders are subject to the GRILLSPIN Shipping Policy, which is incorporated into these Terms by reference.

GRILLSPIN may use authorized third-party warehouses, fulfillment providers, logistics companies, and carriers to prepare and deliver orders.

Shipping estimates, tracking, split shipments, address responsibilities, delivery issues, customs matters, and related procedures are governed by our Shipping Policy and applicable law.

Returns & Refunds

Returns, refunds, defects, damaged products, incorrect products, missing items, cancellations, and related claims are governed by the GRILLSPIN Return & Refund Policy, which is incorporated into these Terms by reference.

GRILLSPIN offers a voluntary 30-day return window measured from delivery for eligible change-of-mind returns, subject to the eligibility requirements and return instructions stated in the Return & Refund Policy.

Damaged, defective, incorrect, missing, or otherwise nonconforming products may qualify for a refund, replacement, re-delivery, replacement parts, or another appropriate remedy depending on the circumstances and applicable law.

Nothing in these Terms or the Return & Refund Policy limits any cancellation, withdrawal, warranty, conformity, refund, repair, replacement, or other consumer right that cannot legally be waived or restricted.

Unauthorized Returns

Merchandise must not be returned unless GRILLSPIN has provided authorization and return instructions.

Products sent to an unauthorized address, returned without authorization, or sent contrary to provided instructions may not be accepted or processed except where applicable law requires otherwise.

Chargebacks & Payment Disputes

Customers are encouraged to contact GRILLSPIN Support first regarding legitimate order concerns so that we have an opportunity to investigate and resolve the matter.

Fraudulent chargebacks, fabricated claims, duplicate refund attempts, altered evidence, intentional product damage, or other abuse may be investigated and disputed.

Nothing in this section limits lawful rights available to customers through their card issuer, bank, payment provider, or consumer-protection law.

Customer Communications

When you contact GRILLSPIN, you agree that we may use the information you provide to respond to your inquiry, investigate an order issue, provide customer support, enforce our policies, prevent fraud, or perform other legitimate functions described in our Privacy Policy.

Reviews, Feedback & Submissions

If GRILLSPIN allows customers to submit reviews, feedback, photographs, comments, suggestions, or other content, you remain responsible for the content you submit.

You must not submit content that:

is knowingly false or misleading;
infringes intellectual-property rights;
contains unlawful threats or harassment;
contains malicious code;
discloses another person's private information without authorization;
is fraudulent or impersonates another person; or
otherwise violates applicable law.

Where you voluntarily submit content for publication, you grant GRILLSPIN a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content solely as reasonably necessary to operate, promote, and improve the Services, subject to applicable law and our Privacy Policy.

Third-Party Services

The Services may depend on or interact with third parties including Shopify, payment processors, carriers, fulfillment providers, analytics providers, customer-support platforms, and other service providers.

GRILLSPIN does not control every independent act, omission, outage, or operational decision of such third parties.

Nothing in this section removes responsibilities that GRILLSPIN cannot lawfully exclude.

Third-Party Links

The Services may contain links to websites or services operated by third parties.

A link does not necessarily mean that GRILLSPIN endorses or controls the third party.

Third-party websites may be governed by their own terms, privacy policies, and practices.

Website Availability

GRILLSPIN aims to keep the Services available and functioning properly, but uninterrupted or error-free access cannot be guaranteed.

The Services may occasionally be unavailable because of maintenance, updates, outages, technical failures, security incidents, third-party interruptions, or circumstances outside our reasonable control.

Suspension or Termination of Access

GRILLSPIN may restrict, suspend, or terminate access to portions of the Services where reasonably necessary and permitted by law because of:

material violation of these Terms;
fraud or security risk;
abusive or unlawful conduct;
attempted unauthorized access;
scraping or automated abuse;
intellectual-property violations;
interference with the Services; or
other conduct that materially threatens GRILLSPIN, customers, or third parties.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as available" basis.

GRILLSPIN does not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Nothing in these Terms excludes or limits any warranty, guarantee, product-conformity obligation, or other consumer right that cannot legally be excluded or limited.

Limitation of Liability

To the maximum extent permitted by applicable law, GRILLSPIN will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the Services where such damages may lawfully be excluded.

This limitation does not apply to liability that cannot lawfully be excluded or limited, including where applicable liability involving fraud, intentional misconduct, gross negligence, personal injury, statutory consumer rights, or other non-excludable obligations.

Nothing in these Terms is intended to deprive a customer of a remedy that applicable law requires GRILLSPIN to provide.

Customer Responsibility for Misuse

GRILLSPIN is not responsible for loss or damage caused by misuse, unauthorized modification, improper operation, failure to follow safety instructions, use contrary to the intended purpose of the product, or other customer conduct, except where applicable law provides otherwise.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable costs arising from your unlawful misuse of the Services, infringement of another party's rights, fraudulent conduct, or material violation of these Terms.

This section does not impose responsibility on a consumer where doing so would be prohibited by applicable law.

Events Outside Reasonable Control

GRILLSPIN will not be responsible for delays or failures caused solely by events outside reasonable control to the extent permitted by law.

Such events may include:

natural disasters;
severe weather;
fires or floods;
war or civil unrest;
government action;
public-health emergencies;
labor disruptions;
carrier disruptions;
customs interruptions;
infrastructure failure;
cyber incidents;
internet or utility outages;
supply-chain interruptions; or
other extraordinary events beyond reasonable control.

This section does not eliminate remedies that applicable law requires despite such an event.

Privacy

Personal information is collected, processed, used, and disclosed in accordance with the GRILLSPIN Privacy Policy.

If these Terms conflict with the Privacy Policy regarding the collection, processing, use, or disclosure of personal information, the Privacy Policy controls for that issue.

Consumer Rights

Nothing in these Terms is intended to waive, exclude, limit, or restrict a consumer-protection right that cannot legally be waived, excluded, limited, or restricted.

Depending on where you live, you may have additional rights concerning product conformity, warranties, defective goods, withdrawal, cancellation, delivery, refunds, repairs, replacements, privacy, or other matters.

Where mandatory law conflicts with these Terms, mandatory law controls.

Governing Law

To the extent permitted by applicable law, these Terms and Conditions and your use of the Services are governed by the laws applicable in the State of Hawaii, United States, without applying rules that would require the application of another jurisdiction's law.

This provision does not deprive consumers of mandatory protections available under the laws of their country, state, province, territory, or other jurisdiction where those protections cannot lawfully be waived.

Disputes

Before initiating formal proceedings, customers are encouraged to contact GRILLSPIN Support and provide us a reasonable opportunity to investigate and attempt to resolve the issue.

Nothing in these Terms prevents either party from exercising rights or remedies available under applicable law.

These Terms do not impose mandatory arbitration or waive a consumer's right to pursue a claim in a court or forum where applicable law gives that right.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally permitted.

The remaining provisions will continue in effect to the extent permitted by law.

No Waiver

GRILLSPIN's failure to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision on another occasion.

Assignment

You may not transfer your rights or obligations under these Terms where doing so would materially interfere with GRILLSPIN's rights or operations without our consent, except where applicable law permits otherwise.

GRILLSPIN may transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other legitimate business transaction, subject to applicable law.

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy, and any additional terms expressly presented in connection with a specific product, promotion, or transaction, constitute the applicable agreement between you and GRILLSPIN regarding the Services.

Policy Priority

If a specific policy governs an issue more directly, that specific policy will control that issue, subject to applicable law.

For example:

privacy matters are governed primarily by the Privacy Policy;
shipping and delivery matters are governed primarily by the Shipping Policy; and
return and refund matters are governed primarily by the Return & Refund Policy.
